agreement governs your purchase of products from Sports Imports LTD
& Sports Imports LLC. Please read it carefully. No
other terms apply. By submitting your order you are agreeing to
these terms.
By using the
Sports Imports LLC and affiliated web sites, you are agreeing to comply
with and be bound by these terms and conditions. If you do not agree to
these terms and conditions, you should not access or use the Sports
Imports Ltd web site. Sports Imports LLC reserves the right at its
discretion to change the terms of this agreement and will notify users
of any such changes by on-line posting. This Web site may contain
typographical errors or inaccuracies and may not be complete or current.
Sports Imports LLC therefore reserves the right to correct any errors,
inaccuracies or omissions (including after an order has been submitted)
and to change or update information at any time without prior notice.
Please note that such errors, inaccuracies or omissions may relate to
pricing and availability, and we reserve the right to cancel or refuse
to accept any order placed based on incorrect pricing or availability
information. We apologize for any inconvenience.

Order Acceptance:
|
All orders of
Products placed by you with Sports Imports LLC and all of its
affiliated web sites shall be subject to acceptance by Sports Imports
LLC. Submission of your order shall constitute full acceptance of
these terms and conditions. IF YOU DO NOT ACCEPT THESE TERMS,
PLEASE DO NOT SUBMIT YOUR ORDER.

Applicable Law:
|
By purchasing
from any of Sports Imports LLC web sites, you agree that the laws of the
State of Maryland, without regard to principles of conflict of laws,
will govern these terms and conditions and any dispute of any sort that
might arise between you and Sports Imports LLC.

Prices:
|
All prices are
in U.S. dollars. Sports Imports LLC makes every effort to ensure that
its prices are up-to-date and accurate. Nonetheless, any pricing
information on this site is subject to change without notice. By
placing an order to purchase a product, you agree to pay the purchase
price set forth on the Sports Imports LLC & Affiliate web sites. In
the event a product is listed at an incorrect price due to a
typographical or programming error, or if an item is added to the
shopping card with an incorrect price from the displayed price, it will
be manually adjusted. Sports Imports LLC has the right to cancel any
order listed at an incorrect price. If your credit card has already
been charged for the purchase and your order is cancelled, Sports
Imports LLC or affiliate web sites will promptly issue a credit to your
credit card account in the amount charged to your credit card.

Payment:
|
Payment must be
included with all orders. We accept, Visa, Master Card, American
Express, Discover, Paypal, Bank Checks and Money orders only. We do not
accept personal checks or Purchase Orders at this time.
We only charge your Credit Card when item is shipped. If your item ships directly from the manufacturer to you then you will receive the item before we charge your credit card. It may take up to 3 months for us to charge your credit card for the shipped item. |

Chargebacks/Disputes:
|
If you initiate
a chargeback with your Credit Card company without first contacting Sports
Imports LLC there will be a $20 charge to your credit card or if the
Chargeback is resolved as not being the fault of Sports Imports LLC.

Shipping:
|
All prices are
F.O.B. (Freight on Board) factory or Rockville, MD. Freight charges will
be collect or prepaid and added to the invoice. Most products are in inventory and ship within 1 to 3 days
from the time an order is received. Large and/or custom orders vary in
shipping times and may be drop shipped from separate locations.
Specific shipping dates cannot be guaranteed. Products are generally
shipped to the US Mainland via United Parcel Service (UPS) and
International shipments via DHL Express, UPS International Express or
the U.S. Postal Service Express Mail. Rates are dependent upon weight,
size, destination and products ordered. Should an order exceed size
and/or weight limitations, motor freight will be used.

Incorrect Shipping Address:
|
If the package has incorrect or incomplete
address information, UPS will charge a fee of $5.00 for
ground shipments, $10.00 for 3-day and faster shipments to correct the
address and deliver the package. Examples of incomplete addresses
include missing Apartment or Suite numbers, or missing floor, if
applicable. Or supplying a PO Box as a delivery address. The UPS
charge will be automatically charged to the customer's credit card.

Undeliverable
Packages & Refused Packages Fees
|
As of January 3, 2006 UPS
charges return shipping for undeliverable or refused packages. This
charge will be passed on to the customer; we are not able to absorb the
charges. Packages refused by the recipient, or which can't be delivered
will be returned to us by UPS for a fee. Undeliverable packages shipped
UPS ground will be charged published UPS ground residential fees
including fuel surcharges both directions. Undeliverable packages
shipped 1, 2 or 3 day will be charged published UPS rates for the
outbound shipment and 3 day published rates including fuel surcharges
for the return shipment. Examples of undeliverable packages include,
but are not limited to, orders that have incorrect address information,
packages that are refused for any reason when delivery is attempted,
packages that aren't delivered in 3 delivery attempts, packages
unclaimed at the UPS local office or any other reason out of UPS
control that result in the package being returned to us. Please make
sure the addresses are correct, the recipient knows the package is
coming and that the location is suitable for daytime delivery of
packages.
Any refused shipments sent back to Sports Imports LLC does not constitute the right to a refund or credit. International Orders are not returnable. If a domestic or International Shipment is refused by the customer and returned back to Sports Imports LLC, up to a 25% re-stocking fee will apply less the shipping cost to the customer and only store credit will be given. It is the customer’s responsibility to make all arrangements with Sports Imports LLC for refused shipments. |

Expedited Shipping:
|
Most of our items
ship within 2 to 3 days. If you request Expedited Shipping such
as UPS Next Day Air, 2nd Day Air or 3 Day, then we will ship your order
via that method. Actual arrival date of your order will depend on
when your order leaves our warehouse. Weekends & Holidays are not counted
for expedited or ground delivery. Expedited Shipping orders are processed quicker, and leave our warehouse faster than Standard ground orders. |

Shipping Costs:
|
Shipping rates
quoted at checkout are best estimates based on the weight of the
package, Actual shipping charges may vary depending on size, shipping location and will be billed at the time of shipment. Shipping Charges also may differ if the dimensions of the
package exceed the weight and is increased to the next weight level as
determined by UPS to be "Oversize 1" or "Oversize 2". - A package is considered "Oversize 1" when its combined length and girth exceeds 84 inches, and combined length and girth is equal to or less than 108 inches, and actual weight is less than 30 pounds. - A package is considered "Oversize 2" when its combined length and girth exceeds 108 inches, and actual weight is less than 70 pounds. |

Shortages:
|
Shortage claims
must be made within 5 working days of receipt date. All claims for
damaged merchandise must be made with the
shipping
carrier. Please keep all shipping cartons and all packing materials
for carrier inspection. Sports Imports LTD cannot initiate any claims
with the carrier. All special orders and custom orders will be
processed in the most timely and efficient manner possible; however,
Sports Imports LLC & LTD will not be held responsible for delays
above and beyond its control.

Returns & Exchanges:
|
To qualify for a refund, ALL items must be returned in new unused re-sellable condition in their original condition, including the original packaging, manufacturer's containers, documentation, warranty cards, manuals, and all accessories. We will not accept returns if the packaging is not in its original condition or the item has been used or installed. We will not accept returns without a Return Authorization clearly visible on the returned item's shipping label. Any refused shipments sent back to Sports Imports LLC does not constitute the right to a refund or credit. International Orders are not returnable. If a Domestic or International Shipment is refused by the customer or Customs and returned back to Sports Imports LLC, a 25% restocking fee will apply less the shipping cost to the customer and only store credit will be given. It is the customer’s responsibility to make all arrangements with Sports Imports LLC for refused shipments. |

Defective Merchandise:
|
If an item is
defective, the manufacturer of the item will either repair or replace
the defective item under their warranty. Any misuse such as using or installing product
incorrectly or any damage caused by customer voids manufacturer's warranty. If you wish to return
the defective item back to Sports Imports LLC for exchange or store
credit, customer must pay for shipping to Sports Imports LLC and
initial shipping to customer is not refundable. Sports
Imports LLC will pay for the replacement shipment, if it applies.

Warranty:

All merchandise sold by Sports Imports LLC or LTD is only subject to manufacturers warranty and conditions, if any, and is subject to submission to the manufacturer for inspection and approval for repair or replacement of merchandise. Customer, however, will be responsible for all shipping and handling fees. No labor or inconvenience may be included in any warranty claims. There is no warranty on lights, light bulbs, decals, electrical parts, engine parts and cannot be returned. Check your state and local laws regarding the use of any parts or accessories. Sports Imports LLC & LTD Customers will acknowledge and agree to these Terms & Conditions once the transaction has been placed with Sports Imports LLC & LTD. |

Parking Sensors:
|
All Parking Sensor Kits
& Backup Camera's are tested prior to shipping. Warranty for
defective components will only be accommodated prior to the installation
of the kit. Once the kit has been installed and working then the
manufacturer's warranty will apply for replacing the defective
component(s). If the kit has been installed and it does not work
then no warranty will apply as it is an installation issue and the kit
will not be accepted for return.
The
Manufacturer, Distributors and/or Retailer's of the Vehicle Parking
(Back-up) Systems do not guarantee or assume liability for "collisions
or damages" that take place when backing up your vehicle. DISCLAIMER OF
IMPLIED WARRANTIES AND LIMITATION ON DAMAGES UNLESS CONSIDERED
UNENFORCEABLE OR UNLAWFUL UNDER APPLICABLE LAW: Neither Sports Imports
LLC & LTD nor it's Distributors will be liable for any claims,
actions, suit proceedings, costs, expenses, damages or liabilities
arising out of the use of this product. The sole undertaking of Sports
Imports LLC & LTD is limited to providing the product as services
outlined herein in accordance with the terms of this Agreement. The
provision of products sold and services provided to the
Customer/Purchaser shall not be interpreted, construed or regarded,
either expressly or implied, as being for the benefit of or creating
any obligation toward, any third party or legal entity outside of
Sports Imports LLC & LTD, it's authorized Distributor and the
Customer/Purchaser.
IMPORTANT NOTE: The Parking Sensors Sold and Distributed by Sports Imports LLC and affiliated websites are strictly a driver assistance device. They should not be used or considered as a safety device for any other purposes. No warranty as to operational efficiency is granted. It is not a substitute for driver responsibility when operating a vehicle. LIABILITY FOR DAMAGES HEREUNDER, REGARDLESS OF THE FORM OR ACTION, SHALL NOT EXCEED THE FEES OR OTHER CHARGES PAID TO SPORTS IMPORTS LTD BY THE CUSTOMER OR THE CUSTOMER'S RETAIL FACILITY FROM WHERE THE CUSTOMER PURCHASED THIS PRODUCT.
