Oklahoma Passes Bill Outlawing Militia Recruitment

Last week the Oklahoma House of Representatives passed a bill that equates recruiting militia members to recruiting gang members.
“Recruiting membership in an unauthorized militia or the Ku Klux Klan would be a crime if legislation approved Thursday by the House of Representatives becomes law. ‘This is making unauthorized militias illegal,’ said Rep. Mike Shelton, the amendment’s author,” News OK reported on Thursday.
Shelton wants to send people to prison who do not ask the state for permission to form a militia. If the bill becomes law, it will likely be challenged as unconstitutional. However, the bill and its passage in the Oklahoma House reveals there is support on the part of lawmakers to deny citizens their rights under the First Amendment (specifically, the right to peaceably assemble).

Shelton exploited the government attack on the federal building in Oklahoma City fifteen years ago in order to rationalize the law. “In Oklahoma, we have seen the damage done by militia fanatics,” he said. “The Ku Klux Klan has a long history of violence and domestic terrorism.”
It sounds like Mr. Shelton has read too much Southern Poverty Law Center literature. The Ku Klux Klan is not only almost entirely dormant — with the exception of a few FBI-run stragglers kept around just in case the race card needs to be played — but the throwback organization has nothing to do with state militia movements.
Even the ADL admits that Timothy McVeigh was not associated with a militia group.
“Involvement in those types of organizations should be treated no differently than participation in an urban gang,” said Shelton, a Democrat.
“Shelton’s amendment was filed about a week after news reports indicated some in Oklahoma tea party groups supported a volunteer militia to help defend the state’s sovereignty against federal government infringement. Several tea party leaders later said they had been talking about reinstituting a state guard, which would help with emergencies and would be under the direction of the governor and Legislature,” News OK adds.
Rep. Mike Reynolds, R-Oklahoma City, asked Shelton if he characterized the Black Panthers as an unauthorized militia.
“Are they going around terrorizing communities, doing drive-by shootings, using ammonium nitrate to blow up buildings?” Shelton asked. “When they start doing that, they would be considered (that).”
Militia groups have never been accused or prosecuted for using ammonium nitrate to blow up buildings.
Shelton’s bill has moved to the Oklahoma Senate.

I am confused by the original article that Nimmo’s report is based upon. It claims the Oklahoma House of Representatives approved this legislation (SB 2018) last week; however, the article later claims Shelton’s legislation was submitted as an amendment to SB 2018—a Senate bill— and passed: “SB 2018 passed 98-1. It now goes to the Senate.”
How can the Oklahoma House of Reps pass a Senate bill and then forward it to the Senate? Did they actually vote on an amendment to a pending Senate bill, which also begs the question, how can the House amend a Senate bill? My confusion could be due to my lack of knowledge concerning Oklahoma legislative procedure.
In any event, it appears the Oklahoma legislature has NOT passed a final bill containing these constitutionally questionable provisions, i.e., a final bill is not on its way to the governor. Sorry to nitpick, Nimmo. Just want to keep you sharp.

I have cleared up my confusion. I pulled up the legislative history concerning SB 2018. It appears the House passed Shelton’s amendment on Apr. 22 by a House vote of 98-1. The amendments were read in the Senate on Apr. 26.
GOOD NEWS: It appears the Senate rejected Shelton’s amendments just yesterday, Apr. 28, and said amendments have been deleted from the bill. A conference has been requested.

Remember guys that state sovereignty was a BIG issure in OK a few years before and leading right up to the OKC Bombing. Well, here we are again, so I’d prepare for something to happen (again). Maybe not in OK again, but perhaps it will. The people of OK are NOT stupid, and they for the most part are starting to see through the sham of the OKC Bombing trial and all the holes in the case against McVeigh, and they don’t believe that “militias” are terrorists like “Al-CIAa” is. My question is, since there is ample evidens that the Murrah building was wired with demolition charges, and most likely the Twin Towers and WTC 7 also, what OTHER federal buildings and/or high profiles structures have been wired for easy detonation when it is convenient for the government to stage another false flag? If this bill passes, then OK can say good-bye to their Second Amendment right to “being a well-regulated malitia” anywhere. This may also be a pretext to more violations of constitutional law in that state if this bill gets passed. Shame, just a damn shame!

If there is strenth in numbers and unity is the power. the malitias should get it right instead of playing to the old paradigm. The paast is dead and gone and it is over. I think that private militias, recruitment and membership in them should be legal.
Most people aren’t going to get involved if they don’t perceive a threat. If they do do see a need for collective security, they should have that option, though obviously some training in the justifiable use of force would be helpful to avoid or minimise potential problems.

Hi guys,
just an idea but if this law does get passed over there why not just beat them at their own game.
Its legal to set up a security firm, so if this law does make militias illegal then you can re-legitimize your militia as a SECURITY FIRM. as a registered company and by playing by there rules you still get to have your armed militia and they can do nothing about it.
and on top of that if all state militias went down the same route you can all join as a collective of SECURITY FIRMS to help each other out when state/federal agencies try infringing on your constitutional rights.
even though the militia is set up as a Security company you would’nt HAVE to TRADE, but as a company you could if you wanted to.
Its just a thought guys. over here in England a lot of Brits have started to play by there rules to our advantage, like making FOI requests to get info from the gov. that they might not want us to see, or using common law as a means to stop the gov. ripping us off with unjust fines and informing the police of there REAL duty to SERVE the PUBLIC/Governed and not to simply do what they are told by their paymasters.
We dont have militias over here in England.

My, my they sure can get a bill passed real quick when they want! I’ve been waiting almost 40 years for a bill that will make the automakers responsible for making the vechicles more milage friendly…we all know they have the ability to get hundreds of miles to a gallon.

I think this is why they’re passing the law–to avoid untrained and armed citizens from killing each other in the woods over fanatical correlations that a democratically elected president is the same as the king of England from hundreds of years ago. Taxes are also at a historically low rate in our country for 98% of it’s citizens.
But for the record it IS a good series, well worth watching imo.

I have something i would like to share with you guys since i see the KKK mention in here. As a young teenage boy one morning while on my way to school on the bus we made a stop at a neighbors home for a pickup. There was a cross burning in the front yard and one across the street from this house. This was the first I ever heard of the KKK. After getting home from school that day I ask my mother what was that all about. I was informed the guy that lived in the house had done some pretty serious bad things with his family and friends. Other words he was not living up to his duties as a father and he owed money to alot of people. The KKK were warning him to straighten up. Well the guy in question was white. His son and I have been friends all our lives. I’m not defending the KKK for what they did but I want eveyone to know they were not against just blacks or any group of a certain color. Alot of what they were for was for people to do the right thing. I’m sure there will be alot of negative comments about what I just said but people need to know the whole story and not what has been depicted on TV.

I wrote a song a while back called “Whos Drivin The Train”. I live by a railroad and everytime the train would come by I would play this driving riff to go with it. When I finished the song at the time (10 years ago) it seemed to radical to record. Today, I think its time may have come. This is the first verse: I hear the train….the whistles blowin, Its rollin down the tracks…..the smokes a flowin, no end to the cars…..on back it’s towin, all those on board…..already knowin.. that the last stops here, there is no going back, its the end of the road, you see their on a one way track….but Dont you wonder now…..Whos Driven The Train. It goes on from there to describe the last group of people at the station getting on board, then closes with the train taking them to their destination. Wasn’t George Mason an author of the 2nd Amendment? Anyway, his words: “I ask you sir, what is the Militia? It is the whole people, with the exception of a few public officials.”
The tenth Amendment makes it pretty clear that Constitutionally the Federal Government gets only the powers that are specifically granted, the rest reseved to the States, or the people.
Even so Article One Section 8 of the Constitution, powers of Congress says “To provide for calling forth the militia to execute the laws of the union, suppress insurrections and repel invasions;
To provide for organizing, arming, and disciplining, the militia, and for governing such part of them as may be employed in the service of the United States, reserving to the states respectively, the appointment of the officers, and the authority of training the militia according to the discipline prescribed by Congress;
Pretty complex stuff.
My own take is that if a group was formed that purported to be the States formal organized Militia, that may be legally called to the service of the State, and actually called out by the President, the State would have the power to reject it as such, and I suppose, even apply penalties. BUT given the right to assembly and the right to bear arms, if a group only represented itself as being part of the great “unorganized Militia” as in “the whole people” I would think the “Peoples Rights” are not in that instance, subject to being forbidden under “States Powers.” If a State for instance forbade Catholics to gather in religious observance it would be crossing that barrier that, to my own mind anyway, places State powers subservient to Peoples rights. So the same would apply to a gathering for a local informal Militia.

for your information ,,,in Oregon ,private militias are illegal and have been for many years. it is a class c felony to form ,belong to ,arm or train in a private militia,,ors. 166.660,, look it up.
anyone over 2 persons joining together to meet with militia activites in mind is also illegal.
i dont like this ,,but it is legal as regards the constitution. refer to title 10 ,us code,, unorganized militia is in regards to state and under command of the gov. members shall remain in their homes with their arms ,till called forth by the gov,,and he shall choose officers or authorize elections or other methods of choosing such.
so you see forming a private militia,and your own officers is violation of title 10 us code ,,which is the militia mentioned in the constitution.
i believe several other states have this law banning private militias ,,but im unsure as to which.
states get around the constitution by having what is caalled a state defense force,which is volonteer and unpaid .and satisfies the constitutional requirement of a citizens militia.
sad but true actually all private militias in country are basicly illegal if they want them top be

I was always curious about Tim McVeigh being captured in a vehicle without a license plate. Also as I understood it at the time of his capture he was armed and pulled over by a deputy. If this was the case I have a hard time understanding that a man who had just killed dozens of people in an explosion, trained in the use of firearms would have allowed himself to be captured at a traffic stop.
If I am wrong I would like some one with perhaps a better memory and closer to the event tell me the facts of the capture.
