OEM vs. Retail
OEM (Original Equipment Manufacturer), White Box, Brown Box, and Retail Boxed versions both contain the same exact product. The only difference is that the Retail Boxed usually comes with more software, longer warranty, and retail packaging. Please check the manufacturers website for more information.

Our sales representatives will help you make informed decisions about the items you purchase from us. computernyc.com reserves the right to refuse technical support service to anyone but we'll be glad to provide manufacturer's contact information for technical support and warranty issues

Product Listings
All product descriptions on our site are there for a quick reference, to give a general idea of the merchandise, and are not designed to replace or contradict your personal knowledge, experience, or research. We try to be as accurate as possible as we can in our descriptions, however occasionally we might have typographical errors. We cannot guarantee and are not responsible for all errors in product features, incorrect or incomplete details or specifications, and incorrect pricing. If in an event where a product is listed with an incorrect price, due to typographical error we have the right to cancel the order, and correct the error. We do not give advice on which merchandise should be bought, nor do we provide any suggestions. Please keep in mind that, you, our valued customer, are entirely responsible for any purchase decision, and we won't be held responsible for any mistake on that end.

Most software that we carry is to be sold with another hardware purchase, and cannot be purchased alone, unless otherwise noted. There will be no exceptions!

Order Processing Time / Order Status [ top ]
All orders will be processed within one or two business days, providing that the item(s) ordered are in stock, and there aren't any problems with the payment verification process. Orders are NOT processed on weekends or Holidays. We do not guarantee same day shipping. computernyc.com will NOT charge your credit card for any backordered merchandise. If we do not have an item in stock, we do not charge you for it. Occasional inventory discrepancies may occur due to inaccurate inventory counts, in that case we will refund the amount charged. We will keep you informed about your order via e-mail. You may also check the status of your order at anytime on our website.
Please note: To prevent delays in processing time, please provide us with the address that you receive your Credit Card billing statements for the Billing Address. If your shipping address is different from your billing address, please call your credit card company to add an alternate address to your account.(Usually there is a toll free number listed on the back of your credit card. If your information can't be verified by your credit card bank, your order will be cancelled. Thanks for your cooperation.

Order Changes and Cancellations [ top ]
You can cancel or make changes to your order, provided that it hasn't yet been processed or shipped yet. We cannot cancel an order that has already been shipped. If you refuse a package shipped from us, it will be considered as a return, and all of the Return and Refund policies will apply. Which means there will be a 20% restocking fee on the merchandise, minus the shipping.

Price Protection [ top ]
computernyc.com always offers the best price possible at the time of an order, but due to the volatility of prices in the computer industry, we cannot offer price protection. The price at the time of a sale is final even if the package is still en-route.

Sales Tax [ top ]
An 8.875% Sales tax will be charged for all orders shipped within New York. If you have a reseller authority for New York, you will need to setup an account with us prior to placing your order.

Like all other retailers, all items are shipped as we have received them from the manufacturers. We do not test any item.

computernyc.com respects your privacy. We do not sell nor release any of your information to anyone. However fraudulant transactions will be reported to the proper authorities. All information that is submitted to and obtained from our website is used solely for the purpose of processing and shipping of your order. All online transactions are sent over to our secured server, which is encrypted with 128-bit SSL technology.

By accepting, signing for, receiving delivery of any product shipped from computernyc.com ("computernyc.com"), you ("customer") agree to the terms and conditions as listed below. You and computernyc.com agree that these are the exclusive terms governing the sales transaction between the Customer and computernyc.com. Any alteration, modification or amendment of these terms and conditions on the customers end will be considered a material alteration, and therefore are void. Please note, these terms are subject to change at anytime without notice. Therefore, please read these terms and conditions carefully each time you place an order, or accept a delivery shipped from computernyc.com.

Warranty

Computernyc.com wants you to be satisfied with your purchase. Our sales representatives will help you make informed decisions about the items you purchase from us.
All System Purchase carries 1-year warranty on parts & labor, 90 days on CPU Chips. Internal Part purchases carry 6 months warranty. Peripheral parts carry 30 days warranty. 7-day money back guarantee with original pre-packaged condition (including the original box, packaging, manuals and accessories), but will be charged a 20% restocking fee. No refunds or exchanges are allowed after 7 days from the date of purchase, or from the date of delivery for online orders. Re-tail boxed products, Notebooks, Monitors, Hard disk drives and printers are sold solely with manufacturer’s warranty. Not responsible for customer’s software problems. Original Invoice and RMA number required for all services. 
Not warranty for physical damage and scratch of the product. Merchandise that has been damaged through carelessness, improper installation, inappropriate packing, missing parts, or neglect on the part of the customer is not covered under warranty and will be returned to the customer at his/her own expense.
Like all other online stores, the customer is responsible for shipping charges when returning hardware for service, exchange, or return. We will cover shipping charges of replacement hardware via UPS Ground to the customer.
All returns for replacement must be accompanied by their original boxes, manuals, cables, etc., and packaged appropriately.
Stickers and barcodes must not be removed from computer hardware; doing so may void the warranty, as they are our means of determining purchase dates & vendor records.

Money Back Guarantee - Refund Period [ top ]
All merchandise unless otherwise noted, can be returned to us within 7 days from the date of receiving the products for a refund. CPU's must be returned within 7 days from the date of the invoice for a refund. An RMA (Return mail authorization) number is required for all returns. However there will be a 20% restocking fee charged against the customers account. Additional deductions will apply for all CPU returns to reflect the current market value. These terms apply to all refunds. You must inform us within 7 days from the date of the invoice, of any damages or defects in the product you have received. We will replace defective merchandise only within this time frame. After which we will not be responsible for. For any warranty PAST this period, you must contact the manufacturer. We will provide all manufacturers' support information, phone numbers and address. However, any physical damage to the merchandise will void the products warranty and we will not replace the merchandise nor issue a refund. Physical damage includes and is not limited to, over-clocking a CPU, bent or missing pins, cracked or chipped cores, burnt chips, removal or tampering of manufactures label. We do not accept refund on any OEM Software. If the software is defective, please contact the software licensor. Customer pays for all costs on return shipping.

Return Merchandise Authorization ("RMA")Procedure.
To return merchandise based upon computernyc.com's replacement/return guarantee, you must first get an RMA number. RMA Numbers can be obtained by filling out our RMA request form. You will be issued an RMA number, which will be used for the return of the merchandise. You must make sure the RMA Number is legible, and it must also be prominently displayed. computernyc.com must receive the merchandise 7-days after being issued an RMA number. We do not reissue RMA numbers, nor do we extend the time allowed Customer is responsible for all shipping costs related to the return of the merchandise. In addition, all returned items, MUST contain all original packaging, manuals, blank warranty cards, Drivers, and all other accessories, and must be in a resalable condition. If any part or accessory of the returned merchandise is missing, we will reject the entire return, or, impose additional charges against the customer to reimburse the cost of replacing the missing accessories. Shipping and Handling charges are non-refundable. We will not refund any shipping and handling charges which includes the Free Shipping Orders. Returns on free shipping orders are subject to an actual charge that is applied by the shipping company.

Restocking fee policy [ top ]
All refunds will be charged a 20% restocking fee, minus the shipping charge. With the exception for CPU's, refunds for CPU's will reflect current market price. Base cost of the CPU will be adjusted to current market price, and then a 20% restocking fee will be applied after this adjustment. Shipping charges are NOT REFUNDABLE. No refund will be issued after 7 days.

PRICE PROTECTION

REFUESED PACKAGES
If an order is refused upon delivery, or returned to Madison Computer Corp. for any reason other than delivery service errors, the customer will be still be billed applicable shipping charges, restocking and COD fees.

IMPORTANT FACTS
We reserve the rights to refuse all orders, prices are subjected to change without notice, pictures in our website are for references only and not responsible for typographic errors.
All prices are not only good for online store, but also available in the local store. For customers who wish to get the online price in our local store, please print out the price and bring it with you when shop in the store.

Software Policy
If customers refuse to purchase system software for their new PCs, Madison Computer Corp. is not responsible for counterfeit, unlicensed or any other software installation and legal problems

LIMITATION OF LIABILITY
Under any circumstance computernyc.com's maximum liability is limited to the purchase price of the products sold. computernyc.com shall not, under any circumstances, be liable for any claim or action on contract, tort, indemnity, or any other claims relating to the products it sells, which exceeds this limit. computernyc.com shall not be liable for any third party claims for damages against the customer, loss of business, interruption of service, loss or damage due to exemplary damages, and or malfunctions. computernyc.com does not manufacture any products sold by computernyc.com; we act solely as a distributor only. The products may be covered by each manufacturers warranty, service, and support policy (if any). Customer acknowledges that any claims of damage shall be made against each individual manufacturer, and not computernyc.com. In addition computernyc.com shall not be held liable for any delays of shipment and delivery, and associated damages, due to events beyond control, including but not limited to, acts of God or public enemy, acts of federal, state, or local government, fire, floods, weather conditions, strikes, lockouts, civil disobedience, freight embargos.General Terms and Conditions

Payment Terms; Orders:
An order is not a binding agreement upon computernyc.com until it has been accepted. computernyc.com MUST receive a payment before it will accept an order, which is due prior to shipment. Customer can make payments by credit card, or any other method, which is prearranged with computernyc.com. Your total cost for any order will be the cost of parts plus shipping and handling charges, as shown on your invoice.

Title; Risk of Loss:
computernyc.com will make arrangements to ship the ordered product(s) /merchandise to the Customer, Free On Board (F.O.B) shipping point, which means title to the product(s) - -except software - -, and risk of loss passes to the Customer upon delivery to the carrier. Carrier will be responsible for Customer's product(s) at this point. Title to software will remain to the individual licensor(s). computernyc.com will not be responsible for delays in shipment, nor lost packages. You must contact the carrier of your package for any inquiries.

Governing Law and Jurisdiction:
The laws of the State of New York shall govern any dispute arising from or related to these Terms and Conditions or the Sales Transaction between computernyc.com and Customer, without regards to its conflicts of law rules. The United Nations Convention on the International Sales of Goods shall not govern the Validity and interpretation of this agreement. computernyc.com and Customer consent to the exclusive jurisdiction and the venue of the State Courts of the State of New York, New York City County, to resolve any dispute between them related hereto, and the parties waive all rights to contest this exclusive jurisdiction and venue of such courts. Finally, the Customer also agrees not to bring into any legal action, based on any legal theory including contract, tort, and equity or otherwise, against computernyc.com that is after one year after the date of the applicable invoice.

Severability:
If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions in this agreement, and the invalid, illegal, and unenforceable provision shall be modified so as to have the closest result that of which is valid and enforceable under New York State law.

Waiver:
The failure of either party to comply with any of the provisions in this agreement shall not affect the first party's right to require such performance at anytime thereafter. Any waiver by either party of any provision in this agreement shall not be held by the other party as a continuing waiver of that provision unless otherwise made in writing.

Entire Agreement:
These terms and conditions, along with computernyc.com's invoice showing the Customers' order, are the complete and exclusive agreement between computernyc.com and Customer, and they supercede all previous proposals, oral or written. This agreement may not be explained by and prior dealings or trade.
